Accused nos.1 to 3 are before this Court in these two writ petitions filed under Articles 226 & 227 of the Constitution of India read with Section 482 of Cr.PC with a prayer to quash the entire proceedings in Crime No.250/2022 registered by Wilson Garden Police Station, Bengaluru, for the offences punishable under Sections 498A & 504 IPC. 2. Learned Counsel for the petitioners and respondent no.2 who is present before the Court jointly submit that the dispute between the parties has been amicably settled before the Mediation Centre at Bengaluru and based on the memorandum of settlement executed between the parties, the marriage of accused no.1 and respondent no.2 has been dissolved by the Family Court at Bengaluru, in M.C.No.4679/2021. 3. Learned Counsel for the petitioner has filed a joint memo along with the affidavit of the parties and he also has produced the memorandum of settlement entered into between the parties and the order sheet of the Family Court in M.C.No.4679/2021. - 5 - HC-KAR NC: 2026:KHC:12127 WP No. 2380 of 2023 C/W WP No. 2445 of 2023 4. The joint memo and the documents produced along with the same, are taken on record. The parties who are present before the Court are identified by their respective learned Advocates. In paragraph VII (2) of the memorandum of settlement executed between accused no.1 and respondent no.2 herein on 25.02.2026 before the Mediation Centre at Bengaluru, it is stated as under: "Both the parties herein agree that there have been some petitions filed by the parties herein against each other and the members of the extended family of each other in the Hon'ble High Court, praying for quashing of the criminal proceedings. Both the parties herein agree that in view of the settlement arrived at as herein they would co-operate with each other in the disposal of the below quashing petitions as per law, bringing it to the notice of the respective Hon'ble High Courts as per the settlement arrived at as herein, in this mediation settlement. The cases being:- i) WP.No.2380/2023 between Maya Santra & Sakti Santra Vs State of Karnataka & Sonam Dutta to quash FIR No.250/2022. ii) WP.No.2445/2023, between Munal Santra Vs State of Karnataka & Sonam Dutta to quash FIR No.250/2022." 5. The order sheet in M.C.No.4679/2021 which was pending before the Family Court, Bengaluru, would go to show that - 6 - HC-KAR NC: 2026:KHC:12127 WP No. 2380 of 2023 C/W WP No. 2445 of 2023 based on the aforesaid memorandum of settlement, the marriage between the parties has been dissolved by a decree of divorce passed on 25.02.2026 in M.C.No.4679/2021. Under the circumstances, I am of the opinion that the prayer made in these two petitions needs to be granted. Accordingly, the following order: 6. Writ petitions are allowed. The entire proceedings in Crime No.250/2022 registered by Wilson Garden Police Station, Bengaluru, for the offences punishable under Sections 498A & 504 IPC, pending on the file of VI Addl.
