Ms. Sonal Sinha Ms. Rajyashree Mukherjee ….. for the State. 1. Parties are represented through their respective learned counsels. 2. The petitioners challenge the action of the respondent in deleting names from the list of the Society without granting opportunity of hearing to the beneficiaries of the Fair Price Shop. 3. The petitioners in the instant are the beneficiaries of a Fair Price Shop (FPS), Barakulberia S.K.U.S. Ltd, being the respondent no.6 herein. 4. The petitioners have already made a representation before the respondent No.3 being annexure-P-3 at page-30 to the writ 2 petition on 21.04.2025, which remains pending for consideration. 5. The petitioners pray for the consideration of the representation dated 21.04.2025 to which the State-respondents has no objection. 6. In view of the above, for the ends of justice, I find that a prima facie case has been made out as the deletion of the beneficiaries’ names from the list of respondent No.6 has caused public inconvenience. 7. After hearing the parties at length and upon perusal of the records I find the respondent no.5 to consider the representation dated 21.04.2025 being annexure p-3 at page-30 to the writ petition within a period of sixty days and shall pass a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioners and other interested parties, if any and communicate the same within one week thereafter. 3 8. With the above direction, this writ petition, WPA 10142 of 2025 stands disposed of without going into the merits of the case. 9. Photostat certified copy of this order, if applied for, be furnished expeditiously. (Smita Das De, J.)
