1. Applicant seeks regular bail in case FIR No.57/2025, registered at Police Station Barakhamba Road for commission of offences under Sections 420/468/471 of IPC.
2. The abovesaid FIR has been registered on the basis of a complaint made by one Sh. Devanand Kumar Sah, who claimed that he was working as Manager in Delhi Darbar Dhaba situated at Babar Road, New Delhi. The applicant, as alleged, used to come there for taking lunch and dinner. During such visits, he assured that he would get his son employed in their office. He claimed that he was working in Nehru Yuva Kendra Sangathan. The complainant believing him made payment of Rs.1,34,500/- through account of his owner.
3. According to the case of prosecution, the accused handed him over a joining letter but when his son contacted the concerned office, it came to fore This is a digitally signed order. that they had been fooled as the abovesaid joining letter was a fake one. Later, the accused promised to return the money in question but since the money was also not returned and he stopped visiting their dhaba and stopped taking their calls, the FIR was registered.

Learned counsel for the applicant supplements that, even otherwise, the prosecution story is a fabricated one. He submits that there is no reason assigned as to why the money had not been paid by the complainant himself and why it was by his owner. Secondly, in the FIR there is no mention of handing over any fake appointment letter and, therefore, the prosecution case does not look to be believable one. 5. Investigation is already complete as charge-sheet has already been filed. The case is lingering on for the purpose that report from FSL is still awaited. 6. Learned Addl. P.P. for the State submits that modus operandi is unusual one and in the similar manner, the applicant has cheated various other gullible persons. 7. Fact, however, remains that, when asked, learned Addl. P.P. for the State, in all fairness, submitted that as far as present case is concerned, there is only one complainant. 8. The applicant is in custody since 23.07.2025 and trial has yet not commenced as the charges have yet not been framed. 9. Nominal Roll of the applicant has been requisitioned from the Jail which indicates his period of incarceration as on 17.08.2026 as 01 year 25 days and his overall jail conduct is recorded as satisfactory. There is one previous involvement of the applicant in a case of the year 2022 but he is on bail therein. This is a digitally signed order. Keeping in mind the overall facts and circumstances of the case, albeit, without expressing any opinion over the merits of the case, applicant is admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class subject to the following conditions:-
(a) Surety would be local. (b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. (c) Applicant/accused shall not come in contact of any witness, directly or indirectly. (d) The applicant/accused shall not leave NCR of Delhi, without permission of learned Trial Court.
(e) The applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. 12. The application stands disposed of in aforesaid terms. 13. Pending application also stands disposed of. 14.
