HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 869/2026 Mohit Urf Pudi S/o Laxman, Aged About 20 Years, R/o Sedh Ka Madh, Mohalla Gopalgarh, Police Station Mathuragate, Bharatpur (Raj.) Presently Lodged at District Jail Bharatpur in Judicial cus- tody. ----Petitioner Versus State of Rajasthan, Through PP ----Respondent For Petitioner(s) : Dr. Abhinav Sharma with Mr. Vishal Choudhary, Ms. Puja Shbarma, Mr. Akshay Varma For Respondent(s) : Mr. Jitendra Singh Rathore, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 10/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No. 578/2025 registered at Police Station Mathuragate, District Bharatpur, for offence under Section 304(2), 112(2) of B.N.S. 2. Learned counsel for petitioner submits that the petitioner, who is an innocent person, has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that the case of prosecution is that an unknown person snatched a mobile phone from the complainant and unauthorizedly transferred Rs. 3,000/- from his bank account to another account. Learned counsel also submits that there exists no direct evidence to link petitioner to the alleged incident. 3. Learned counsel further submits that co-accused namely, Surjeet has already been granted bail by the trial Court. He (2 of 2) [CRLMB-869/2026] also submits that the offences are triable by Magistrate; the petitioner is in custody since long, the charge-sheet has been filed in the matter and no recovery is required to be made from the petitioner, so no fruitful purpose would be served by keeping him in custody, and therefore prays to enlarge the petitioner on bail. 4. Per contra, learned Public Prosecutor vehemently opposes the bail application and submits that there are seven criminal cases pending against the petitioner, hence, he may not be released on bail. 5. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that charge-sheet has been filed and the alleged offences are triable by Magistrate, trial will take considerably long time in its conclusion, thus, without com- menting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Mohit Urf Pudi S/o Laxman is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
