1. This is the second bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.214/2024 registered at Police Station Arjunda, District Balod (C.G) for the offence punishable under Sections 64 (2) M, 65 (1) of Bhartiya Nayaya Sanhita and Section 5 (j)(ii)/(l), 4 and 6 of Protection of Children from Sexual Offences Act and Section 3 (2) (v) of SC/ST (Prevention of Atrocities) Act. 2. The First Bail application of the applicant was dismissed as withdrawn with liberty to repeat the same after examination of parents of the victim, as well as the School Teacher vide order dated 07.05.2025 passed in MCRC No.2252 of 2025.
3. After arguing for some time, counsel for the applicant prays for withdrawal of the present MCRC petition, however, he would submit that the applicant is in jail since 01.12.2024, therefore, the learned trial Court may be directed to expedite the trial of the case.
4. The said prayer is not opposed by learned State counsel.
5. As per the submissions made by counsel for the applicant, the present bail petition is dismissed as withdrawn.
6. Considering the fact that the applicant is in jail since 1.12.2024 and upto 18.11.2025, only seven witnesses have been examined, the learned trial Court is directed to expedite the trial of the case.
7. A copy of this order be forwarded to the trial Court for due compliance. Sd/-
