The prayer Nos.1(a) and 1(b) are quoted hereinbelow:- (a) Issuance of writ/ writ, order/ orders, direction/ directions for commanding upon the respondent number 2 and 3 for payment of the arrears of work done (with interest), done by the petitioners as a caterer care taking, up keeping, maintenance, and other related service at Bokaro Parisadan and officer’s Rest house, Bokaro as per the agreement dated 22.10.2016 between the petitioner and the District Nazarat Bokaro (Annexure number-44) and the Earnest Money Deposit and Security money deposited by the petitioner. (b) Issuance any other appropriate writ/ writs, order/ orders, direction/ directions commanding upon the respondent no.2 and 3 that they may pay Additional G.S.T. from 1.7.2017 so the petitioner may not be penalized by the Authority. (Which the petitioner was charged from the month of July 2017 @ 18% which the petitioner ought to pay the government and if not paid will have to pay Rs.200 per day along with interest on due tax @ 18%. And if the GST is paid additional Rs.28,925 extra amount per month is required to be paid as GST, for which the petitioner requested No.3 and 3) (Annexure-12) 3. It is the case of the petitioner that he has undertaken several works as caterer/ care taker for up-keeping, maintenance and other related services at Bokaro Parisadan and officer’s Rent House, Bokaro as per the agreement dated 22.10.2016 but he has not been paid dues properly. 4. Learned counsel for the petitioner submits that the petitioner has also filed a detail representation and has made his claim on 13.10.2018 itself (Annexure-44) but no action has been taken. 5. Considering the said submission, I direct the petitioner to approach the respondent No.2-Deputy Commissioner, Bokaro along with a copy of this writ petition, which will be treated as a representation. 6. The Deputy Commissioner, Bokaro will form a committee of three responsible officers, who will inspect the documents and other records and, thereafter, will arrive at the conclusion whether the petitioner has completed the work or not and whether the petitioner is entitled for any dues or not. If it is found that the amount, which the petitioner has claimed and is entitled to but the same has not been paid, the Deputy Commissioner, Bokaro will take steps for making payment to the petitioner at the earliest. 7. If any part of the claim, which the petitioner is making, is disputed, the same should be communicated to the petitioner. In that case, the petitioner is at liberty to approach the Civil Court. 8. It is expected that entire process should be concluded within a period of sixteen weeks from the date of receipt of copy of this order. 9.
