This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.307/2025 registered at Police Station – Gandhinagar, Ambikapur, District- Surguja (C.G.), for the offence under Sections SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.01.27 11:11:32 +0530 2 317(4), 318(4), 319(2) and 61(2) of the BNS, 2023. 2. The prosecution case, in brief, is that information received through the coordination portal of the Indian Cyber Crime Coordination Centre, via the Cyber Cell, revealed multiple online complaints lodged in different States under various acknowledgment numbers. Upon verification, it was found that the complainants had transferred amounts of ₹10,00,000/-, ₹17,50,000/-, ₹30,000/- and ₹4,00,000/- respectively through online mode, and a total sum of ₹16,05,000/- was deposited in Account No. 20240000019948 maintained in the name of the present applicant at ESAF Bank, Ambikapur. Based on the above allegations, the aforesaid offences have been registered against the present applicant. Hence this application. 3. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in this case. He further submits that the applicant is the Director of Bharat Sevak Samaj operated by Sutradhar Samajik and Jan Kalyan Samiti, District Koriya, Chhattisgarh, duly affiliated with Bharat Sevak Samaj, Satbhawana Bhawan, Thiruvananthapuram, and the institution offers diploma courses in medical laboratory technology, X-ray technology, critical care management, ophthalmic assistance and patient care. He further submits that the amount credited to the applicant’s bank account represents legitimate fees received from students for pursuing the said 3 diploma courses, the applicant has neither deceived any person nor induced anyone to invest money, nor has he received or deposited any amount by fraudulent means. He lastly submits that he is in jail since 26.06.2025, the charge-sheet has already been filed and the trial is likely to take considerable time, therefore, he may be granted regular bail. 4. On the other hand, the learned State counsel opposes the bail application 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submission made by learned counsel for the parties, further considering that specific allegations have been levelled against the applicant regarding receipt of substantial amounts from multiple complainants through online transactions and the explanation offered by the applicant that the said amounts were towards educational fees requires detailed examination and cannot be accepted at this stage, further considering the nature of allegations, and the seriousness of the offence and its wider impact, this Court is not inclined to grant bail at this stage. 7. Accordingly, the bail application of the applicant – Sudhir Kumar Sharma involved in Crime 307/2025 registered at Police Station – Gandhinagar, Ambikapur, District- Surguja (C.G.), for the offence under Sections 317(4), 318(4), 319(2) and 61(2) of the BNS, 4 2023, is hereby rejected. 8.
