Heard learned counsel for the petitioners and learned AGA for the State-respondent nos. 1 & 2. 2. The present writ petition has been filed challenging the FIR dated 23.09.2026 registering Case Crime No.722 of 2026, under Sections 191(2), 191(3), 109(1), 125, 352, 333, 324(4), 131 and 351(3) of B.N.S., Police Station Banna Devi, District Aligarh. 3. It has been argued by the learned counsel for the petitioners that parties are already contesting civil dispute between them and the first information report is consequence of the said civil dispute. It has further been argued that the F.I.R. has been lodged for mala fide reasons to coerce the petitioners. It has also been argued that for the aforesaid reasons, the first information report is liable to be quashed. 4. Learned AGA has opposed the present petition. 5. In view of the order proposed to be passed, it would serve no useful purpose by issuing notice to respondent no.3 and calling for a counter affidavit. 6. Accordingly, without entering into the merits of the case and after considering the arguments of the counsel for the petitioners, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance of the First Information Report dated 23.09.2026 Versus Counsel for Petitioner(s) : Ansar Ahmad Counsel for Respondent(s) : G.A.
