The petitioner claims that, by virtue of the order dated 25.03.2025 passed in W.P. No. 6578 of 2025, and the order dated 28.07.2025 passed in Review Application (Writ) No. 155 of 2025, the aforesaid encumbrance has to be removed from the Encumbrance Certificate by the respondents 4 to 6. https://www.mhc.tn.gov.in/judis

The petitioner had given several representations to the respondents 4 to 6, which includes the last representation dated 13.02.2026, requesting them to remove the aforesaid encumbrances, reflected in the Encumbrance Certificate for the subject property. Since the said representations have not been considered till date, this writ petition has been filed. 4. Mr. P. Harish, learned Government Advocate accepts notice on behalf of the respondents 1 to 6. 5. No prejudice would be caused to the respondents if the petitioner’s representations, as stated above, are directed to be disposed of by the 6th respondent, on merits and in accordance with law, after hearing the objections of the 7th respondent and any other third party whom the 6th respondent deems it fit to enquire, within a time frame to be fixed by this Court. 6. This Court is not expressing any opinion on the merits of the petitioner’s representations. 7. Since no adverse orders are passed against the 7th respondent in this writ petition, notice to the 7th respondent is dispensed with by this Court. 8. Accordingly, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
