Mr. Monoranjan Jana …for the Petitioners It is the grievance of the petitioners that respondent nos. 9 to 12 have constructed four shop rooms in front of their house. The learned Advocate appearing for the petitioners submits that, due to such construction, the ingress to and egress from their residential house have been obstructed. However, neither in the writ petition nor in the representations made by the petitioners before the respondent authorities has it been alleged that the shop rooms were constructed without any sanctioned plan from the competent authority. The writ petition merely describes the construction of the shop rooms as illegal. It is also not the case of the petitioners that the shop rooms have been constructed on land belonging to them. In the considered view of this Court, the petitioners have raised a dispute that is purely civil in nature, which cannot be adjudicated in the writ jurisdiction. In view of the aforesaid, WPA 17762 of 2024 stands dismissed. 2 The dismissal of the writ petition shall not preclude the petitioners from approaching the appropriate forum for redressal of their grievances.
