ORAL ORDER Joint memo is filed. Contents of the joint memo reads as under:
“The Petitioners and Respondent herein above file the Joint Memo as below:
1. That, the above Criminal Revision Petition arises out of the proceedings initiated under Section 138 of Negotiable Instruments Act, pertaining to the disputed cheque.
2. That, with the intervention of well-wishers and elders, the parties have amicably settled the dispute out of the court, for an amount of 8,47,500/- (Rupees Eight lakhs forty seven thousand five hundren Only).
3. That, the Petitioners have already deposited an amount of Rs.5,00,000/- (Rupees Five Lakhs Only) as per the order of the Hon'ble

LXVI Addl. City Civil And Sessions Judge, Bengaluru and this Hon'ble Court.
4. That, Petitioners undertakes to pay the remaining balance amount of Rs.3,47,500/- (Rupees Three Lakhs forty seven thousand five hundred Only) in four equal monthly instaliments, as mutually agreed between the parties.
5. That, the Respondent has agreed to receive the said amount towards the full and final settlement of all claims arising out of the disputed cheques. WHEREFORE, the parties most humbly pray that this Hon'ble Court be pleased to take this Joint Memo of Settlement on record and be pleased to dispose of the above Criminal Revision Petition as settled out of the court, in the interest of justice.”
2. Placing the joint memo on record, petition stands
disposed of.
3. Amount in deposit is ordered to be withdrawn by the complainant under due identification.
4. Balance amount of the compensation if not paid as agreed in the joint memo petitioner shall undergo

imprisonment as ordered by the learned Trial Magistrate, confirmed by the First Appellate Court.
