(1) 10wp2309.25 IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH : NAGPUR WRIT PETITION NO.2309/2025 Arun Dewman Chavan .VS. State of Maharashtra and Ors. --------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. Vipul Bhise, Advocate for petitioner. Mr. S. B. Bissa, A.G.P. for respondent No.1. Mr. P. J. Mehta, Advocate for respondent Nos. 3 and 4. Mr. S. R. Puddatwar, Advocate instructed by Mr. D. M. Kale, Advocate for respondent No.5 and 6. CORAM : ANIL L. PANSARE AND NIVEDITA P. MEHTA, JJ. DATE : OCTOBER 7, 2026 Heard. 2. The petitioner has been appointed as Gram Vidyut Vyavasthapak, in terms of the provisions of Government Resolution dated 20.10.2016. It provides that the Gram Panchayat will act as franchise to implement the services provided by the Maharashtra State Electricity Distribution Company Ltd. (MSEDCL). It further provides for procedure for appointment and empowers the Gram Panchayat to make such appointment. Remuneration amounting to Rs.3,000/- is, however, payable by the MSEDCL. The selection procedure prescribes that the candidate once selected will have to undergo a skill development training through the MSEDCL. Once the training is completed the Gram Panchayat is supposed to issue order for 11 months. 3. In the present case, Gram Panchayat has issued order of appointment prior to completion of training. The Gram Panchayat, despite issuing appointment order, has now taken a stand that burden to pay remuneration is on MSEDCL. 4. The appointment order was issued on 07.10.2024. Neither MSEDCL has imparted training to the petitioner nor has Gram Panchayat taken services after issuing appointment order. The (2) 10wp2309.25 appointment was for 11 months and by efflux of time, the petitioner is relieved from service. The question, therefore, is who will be now responsible to make payments for 11 months. 5. Considering the lapses at the hands of the Gram Panchayat and the MSEDCL, we direct them to pay remuneration jointly. Total amount of Rs.33,000/- will be accordingly paid by Gram Panchayat and MSEDCL i.e. Rs.16,500/- each. The amount shall be paid within four weeks from today. The petitioner shall supply his account details to both the parties. 6. The petition is disposed of in terms of the above. (JUDGE) (JUDGE) Kahale Signed by: Kahale Designation: Senior Pvt.
