GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to pass writ order or direction more particularly one in the nature of writ of mandamus under Article 226 of constitution by Declaring the action of Respondents 3 to 4 (police authorities) in interfering with the civil dispute relating to land in Survey N0.357/2B, admeasuring Ac.2.64 cents in Aagaveli Village, Krisnagiri Mandal, Kurnool District,as illegal, arbitrary and contrary to law, Consequently, direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subject land and direct the respondent no 3 and to return the seized cell phones to the petitioner family …” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. B. Suryanarayana, learned counsel for the Petitioner, submits that Respondent Nos.3 and 4 are interfering with the civil dispute relating to land in Survey No.357/2B, admeasuring Ac.2.64 cents in Aagaveli Village, Krisnagiri Mandal, Kurnool District. He further submits that three mobile phones belonging to the Petitioner were seized by the Respondent Police. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the dispute is purely civil in nature concerning land ownership, and the police have not interfered with title or possession. He 3 further submits that the police acted only upon a complaint disclosing cognizable offences and an apprehension of breach of peace. It is also submitted that both parties were merely called for enquiry and advised to approach the competent civil court. He further submits that no such seizure of mobile phones was made. 5. Having regard to the facts and circumstances of the case, and in view of the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to interfere henceforth in the civil dispute between the Petitioner and the unofficial Respondents without following the due process of law. The Respondent Police are further directed to hand over the three mobile phones to the Petitioner, if the same have been seized and are still in their custody. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
