SOMISETTY GANESH BABU SC For VUDA and MUDA 2. GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: ORAL ORDER: Heard Sri P. Vinod Kumar, learned Counsel appearing on behalf of Sri Srinivasa Rao Bodduluri, learned Counsel for the Writ Petitioner, Sri M. Srinu Babu, learned Assistant Government Pleader for Municipal Administration and Urban Development, Sri S. Vijay Kumar, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Greater Visakhapatnam Municipal Corporation and Sri T. Karthik Chandra Kumar, learned Counsel appearing on behalf of Sri Somisetty Ganesh Babu, learned Standing Counsel for Visakhapatnam Metropolitan Region Development Authority. 2. Sri T. Karthik Chandra Kumar, learned Counsel appearing on behalf of Sri S. Ganesh Babu, learned Standing Counsel for Respondent No.2, has submitted the Written Instructions furnished by the Metropolitan Commissioner dated 15.02.2026 (digitally signed). Sri S. Vijay Kumar, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Greater Visakhapatnam Municipal Corporation, has also submitted the Written Instructions furnished by the Zonal Commissioner, Zone-VIII, GVMC. Copies of both the Written Instructions are supplied to the learned Counsel for the Writ Petitioner and the same is taken on record. 3. The Written Instruction of Metropolitan Commissioner dated 15.02.2026 would indicate that the Respondent Officials have newly planned for laying of a road under the District Action Plan-2041, for which the feasibility Report was obtained from the Tahsildar, Pendurthi. The Written Instruction would also indicate that the Respondent Officials have newly prepared RDP No.04/2025 dated 10.03.2025 and while preparing the said RDP No.04/2025, the Official Respondents have issued a Paper Notification on 05.12.2024, calling for objections and suggestions. The Written Instruction would further state that 3 number of objections came from the farmers under RDP No.04/2025 and also that the farmers have not expressed their willingness to accept TDRs as per the rules. The villagers have also submitted a grievance through PGRS on 19.01.2026 requesting the Respondents to consider realignment of the Master Plan Road along with the existing road. Considering the same, RDP No.13/2025 was prepared and submitted to the Government along with the grievance submitted by the villagers through PGRS dated 19.01.2026 and the same is under consideration. 4. The Written Instruction, would therefore, indicate that in view of the objections raised by the villagers and also due to their unwillingness to accept TDRs, the Master Plan Road alignment under RDP No.04/2025 has now been scraped and it has been decided to follow RDP. No.13/2025. It is noticed that the Petitioner’s land falls in Sy.No.127/8 of Pedagadi Village, Pendurthi Mandal, Visakhapatnam District, which falls under RDP No.04/2025. Whereas, the new proposal of the Government under RDP.No.13/2025 does not include the Petitioner’s land. 5. Since the proposal is pending with the Government, this Court is of the opinion that there is no cause of action for the Writ Petitioner to agitate as of now. Accordingly, this Writ Petition is disposed of. No order as to costs. 6. Needless to state that the Respondents shall follow the due process of law. 7. Interlocutory Applications, if any, stand closed in terms of this order. ______________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J Dt:24.02.2026 Vns
