In this Writ Petition, petitioner is assailing the Order dated 05.02.2026 (Annexure-Q) passed by respondent No.3 and the certificate of registration in Registration No.58498/2025-26 (Annexure-R), issued by the competent authority in favour of respondent No.6. 2. Heard Sri. Somashekaraiah R.P., learned counsel appearing for the petitioner and Sri. Yogesh D. Naik, learned Additional Government Advocate appearing for the respondent Nos.1 to 3. 3. It is argued by the learned counsel for the petitioner, that the order of granting registration at Annexure-Q to respondent No.6 is contrary to the provisions of the Karnataka Co- - 4 - HC-KAR NC: 2026:KHC:12572 WP No.5863 of 2026 Operative Societies Act, 1959 as well as the orders passed by this Court in W.P.No.408/2026 dated 12.01.2026 (Annexure-L) and dated 02.02.2026 (Annexure-N), and accordingly, sought for interference of this Court. 4. Per contra, learned Additional Government Advocate appearing for respondent Nos.1 to 3 submitted that the petitioner has preferred an appeal before the respondent No.2 herein and therefore, the Writ Petition is not maintainable and the petitioner be relegated to approach the respondent No.2 for redressal of his grievances and accordingly, sought for dismissal of the Writ Petition. 5. In the light of the submissions made by the learned counsel appearing for the parties, it is not in dispute that the petitioner - Society was registered on 25.09.1993 (Annexure- A). It is also forthcoming from the Writ Petition that the respondent No.6 has been registered as per the impugned Registration Certificate dated 05.02.2026 (Annexure-Q) to the Writ Petition. It is forthcoming from the Writ Petition that the petitioner herein has filed appeal before the respondent No.2 (Annexure-H) challenging the order dated 03.01.2026 passed - 5 - HC-KAR NC: 2026:KHC:12572 WP No.5863 of 2026 by the Assistant Registrar of Co-Operative Societies (Annexure- K therein) and the said appeal is pending consideration before the respondent No.2. 6. In that view of the matter, since the petitioner herein has already preferred an appeal before the competent authority i.e., respondent No.2, the petitioner is permitted to approach the respondent No.2 for further action in the pending appeal. It is also made clear that the averments and the grounds urged before this Court in the present Writ Petition are permitted to be raised before respondent No.2 in the pending appeal. Respondent No.2 is directed to dispose of the appeal at the earliest within a period of four months from the date of receipt of certified copy of this order.
