Jyoti Thakur, W/o Badal Kumar Thakur, R/o Bypass Road, Upper Bilasi Town, P.O., P.S. & Dist.-Deoghar, Jharkhand .... Petitioner(s). Versus 1. The State of Jharkhand 2. Deputy Commissioner, Deoghar 3. Land Reforms Deputy Collector, Deoghar 4. Circle Officer, Mohanpur, Dist.-Deoghar, Jharkhand … Respondent(s) ------ CORAM : SRI ANANDA SEN, J. For the Petitioner(s) : Mr. Chandrajit Mukherjee, Advocate For the State : Mr. Mohan Kr. Dubey, AC to AG …...... 02/ 08.06.2026 Heard, the learned counsel for the petitioners and learned counsel appearing on behalf of the State. 2. It is the grievance of the petitioners that vide Annexure-1 orders dated 09.10.2025 passed in Mutation Appeal No. 02/2023-24 and order dated 21.11.2025 passed in Mutation Appeal Nos. 21, 22, 23, 24, 25 & 26 of 2024-25, the Land Reforms Deputy Collector, Deoghar has directed to mutate the land in the name of the petitioners in respect of the land, which was the subject matters of those appeals. 3. It is grievance of the petitioners that despite of the aforesaid order, the Circle Officer, Mohanpur is not mutating the name of the petitioners and granting the rent receipt after accepting the rent, which forced these petitioners to approach this Court. 4. After going through the Annexure-1, I find that there is clear direction to mutate the land in question in favour of the appellants of the mutation appeal. Once, an order has been passed and if it is not been set aside, the same needs to be complied with in its true letter and spirit. It is very surprising that for this purpose, the petitioners are invoking Article 226 of the Constitution of India. The Executive Authorities are duty bound to do the same. 5. Thus, I direct the petitioners to approach the Deputy Commissioner, Deoghar along with the copy of this order and the order passed in appeals and make necessary prayer. The Deputy Commissioner, Deoghar will give necessary direction to the Circle Officer, Mohanpur, Deoghar immediately and ensure compliance of orders dated 09.10.2025 passed in Mutation Appeal No. 02/2023-24 and order dated 21.11.2025 passed in Mutation Appeal Nos. 21, 22, 23, 24, 25 & 26 of 2024-25 passed by the Land Reforms Deputy Collector, Deoghar, if there are no other legal impediments. 6. Accordingly, this writ petition stands disposed of. (ANANDA SEN, J.) 08th June, 2026 R.S./S.K.C. Uploaded on 09/06/2026
