Learned counsel for the petitioner submits that this interlocutory application has been filed with the prayer to delete the name of the opposite party no.2 as he has died. Perusal of the record reveals that the opposite party no.2 is the Industrial Development Officer of Giridih. The petitioner has not come to the court with clean hands by not mentioning who is the present Industrial Development Officer of Giridih , even though the F.I.R. has been instituted by the informant in his official capacity. So, this Court is not inclined to delete the name of the opposite party no.2 which is the Industrial Development Officer, Giridih.
