JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 14-05-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner has prayed for bail in connection with Kumarkhand P.S. Case No. 02 of 2026 registered for the offence punishable under Sections 115(1), 126(2), 103(1), 351(2), 3(5) of the B.N.S., 2023. 3. The case of the prosecution, in short, is that one Manisha Kumari (deceased) was married to the petitioner in the year 2017. She was being subjected to cruelty by her in-laws. On 05.01.2026, the informant received an information from the locals that the deceased had been killed by her in-laws. The informant believes that she has been assaulted and has been killed by throttling and electrocution. Patna High Court CR. MISC. No.33071 of 2026(2) dt.14-05-2026 2/3 4. Learned counsel for the petitioner submits that the nature of the allegations is general and omnibus. It is further submitted that, upon perusal of the post-mortem report, it transpires that the doctor conducting the autopsy found the following ante-mortem injuries on the body of the deceased: ‘Rigor mortis present in the upper limbs; ligature mark present on the neck measuring approximately 01 × 0.5 cm with superficial skin involvement.’ The doctor has opined that the cause of death was asphyxia due to hanging. 5. Learned counsel further submits that the learned trial court has recorded that, “It appears from paragraphs 61, 62, 63, and 64 of the case diary that the local witnesses have supported the theory of suicide by self-hanging by the victim.” It is further submitted that the post-mortem report also suggests that the death occurred due to hanging. 6. He further submits that the post-mortem also suggest that the death was due to hanging. He further submits that after investigation, police has submitted chargesheet under Section 108 of the B.N.S. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since Patna High Court CR. MISC. No.33071 of 2026(2) dt.14-05-2026 3/3 06.01.2026. 5. The application for bail is opposed by learned APP for the State. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Madhepura in connection with Kumarkhand P.S.
