[2026:JHHC:16275] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.4254 of 2026 ------ Budhram Munda @ Budhu Munda aged about 23 years S/o Khudiya Munda resident of village Garamara, P.O. Maranghada, P.S. Maranghada, District- Khunti. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Anil Kr. Ganjhu, Advocate For the State : Mr. Shree Prakash Jha, Addl.P.P ------ Order No.02 Dated-08-06-2026 Heard the parties. The petitioner has been made accused in connection with Maranghada P.S. Case No. 14 of 2025 corresponding to G.R. Case No. 358 of 2025 (S.T. Case No. 126 of 2025) registered for the offences punishable under Sections 103(1), 3(5) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with Achu Munda, has committed murder of Gangu Munda by assaulting him with lathi and sharp cutting weapon. It is next submitted that the allegation against the petitioner is false. It is then submitted that the allegation of assault with sharp cutting weapon is upon the co-accused Achu Munda and the allegation against the petitioner is only of assaulting the deceased with lathi. It is next submitted that the petitioner has been in custody since 12.04.2025 as is evident from para-21 of the instant bail application. It is then submitted that the petitioner has no criminal antecedent as mentioned in para-21 of the bail application. It is further submitted that the petitioner is ready and willing to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned counsel appearing for the State on the other hand opposes the prayer for bail of the petitioner and submits that in view of Section 3(5) of the B.N.S., 2023, both the petitioner as well as the co- accused were squarely liable for the acts committed by them in furtherance of their common intention and in view of the direct allegation of serious nature against the petitioner, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner as well as chance of his absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the above named petitioner to bail. Accordingly, the prayer for bail of the above named petitioner is rejected. (Anil Kumar Choudhary, J.) Dated:- 08.06.2026 Saroj/
