The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking directions for expeditious conclusion of proceedings, in an application filed by him before the Magistrate’s Court under Section 156(3) of the Code of Criminal Procedure, 1973 [“CrPC”]. 2. Ms. Moulishree Pathak, learned counsel for the petitioner, states that the application was filed in the year 2022, but remains pending. 3. I am informed that the Investigating Officer has submitted action taken reports dated 04.11.2022 and 14.02.2026 before the concerned Court. 4. As the said application under Section 156(3) CrPC is pending since This is a digitally signed order. Although Ms. Pathak submits that a separate complaint under Section 200 CrPC has also been registered at the instance of the petitioner, being Complaint Case No. 450/2022, it prima facie appears from the documents placed on record that the application under Section 156(3) CrPC is, in fact, a part of the record of FIR No. 90/2012, registered at Police Station Crime Against Women Cell, Nanak Pura, at the instance of the petitioner’s daughter-in-law. If that is so, the petitioner may request the learned Magistrate’s Court to treat the application, although filed in FIR No. 90/2012, as a separate complaint. 6. The petition stands disposed of with the aforesaid directions. 7. It is made clear that this Court has not issued notice to the proposed accused, and no rights and contentions have been considered on merits.
