On that day, the parties were directed to remain present, before this Court, today, on 01.04.2026. 2. Petitioner–Diksha   Devi   has   approached   this Court, by way of the present petition, under Section 24 of the Code of Civil Procedure (hereinafter referred to as ‘the CPC’), seeking   transfer   of   HMA   Petition   No.18   of   2025,   titled   as Pramod   Kumar   versus   Diksha   Devi,   instituted   by   the respondent­husband   before  the  Court  of  learned   Additional Principal Judge, Family Court, Ghumarwin, District Bilaspur to the Court of learned Principal Judge, Family Court, Solan, District Solan, H.P. 4. According to the petitioner­wife, she was married to respondent­husband, on 23.10.2014. After the marriage, she has started residing with the respondent­husband and out of the said wedlock and the parties to the lis have been blessed with child namely Suryansh. 5. According   to   the   petitioner­wife,   thereafter,   she had   filed  the  petition   for  divorce,   under   Section   13   of   the Hindu   Marriage   Act   (hereinafter   referred   to   as   ‘the   Act’), 3 2026:HHC:9666 before the Court of learned Principal Judge, Family Court, Solan. 6. Subsequently, respondent­husband  filed petition, under Section 9 of the Act, bearing HMA Petition No.18 of 2025, before the Court of learned Additional Principal Judge, Family Court, Ghumarwin, District Bilaspur. 7. According   to   the   petitioner,   she   has   filed   the divorce petition, prior in time and as a counter blast thereto the respondent­husband has filed the petition under Section 9 of the Act. 8. On the basis of the above facts, a prayer has been made to allow the petition. 9. Along with the present petition, the petitioner­wife has   annexed   the   photocopy   of   the   petition,   filed   by   the respondent­husband,   under   Section   9   of   the   Act. Today, despite directions of this Court, neither respondent­husband, nor, his counsel has bothered to put appearance before this Court to controvert the allegations, which have been levelled in   the   transfer   application. Meaning   thereby,   whatsoever asserted by the petitioner­wife, which is duly supported by the 4 2026:HHC:9666 affidavit,   has   not   been   controverted   by   the   respondent­ husband. 10. Considering the fact that the convenience of the wife   is   paramount   consideration,   in   such   type   of   matters, coupled   with   the   fact   that   whatsoever   pleaded   by   the petitioner­wife, in the petition, remained uncontroverted,  this Court is of the view that the present petition is liable to be allowed. 11. Consequently, the petition is allowed and the case bearing  HMA   Petition   No.18   of   2025,   titled   as  Pramod Kumar versus Diksha Devi, pending adjudication before the Court of learned Additional Principal Judge, Family Court, Ghumarwin, District Bilaspur is transferred to the Court of learned Principal Judge, Family Court, Solan, District Solan, H.P. 12. Learned   Principal   Judge,   Family   Court,   Solan, District   Solan,   H.P.,   is   requested   to   proceed   further,   after securing the presence of both the parties. 13.
