PUBLIC PROSECUTOR The Court made the following: 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 662/2026 ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 and 2 for granting of pre-arrest bail in connection with Crime No.359 of 2025 dated 25.12.2025 on the file of I Town Police Station, Anantapuramu registered for the alleged offence punishable under 336(3), 318(4), 324(4), 329(4), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’). 02. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor on behalf of the State. 03. Learned counsel for the petitioners/A.1 and A.2 would submit that one Kanakadurga executed an un-registered sale deed in favor of accused No.1 dated 24.05.2024. The said Kanakadurga died on 03.11.2024, after the demise of Kanakadurga, A.1 became the absolute owner of the property. Learned counsel would further submit that, thereafter A.1 has executed a registered GPA in favor of Accused No.2 on 01.07.2025. Learned counsel would further submit that petitioners herein filed a civil suit vide O.S.No.1138 of 2025 on the file of Junior Civil Judge, Anantapuramu seeking permanent injunction, but they could not 4 get any interim order in the said matter. Learned counsel for the petitioner would further submit that except the relationship with the deceased Kanakadurga, respondent No.2 has nothing to do with the said property. Learned counsel would further submit that after receiving the suit summons, this case has been lodged against the petitioners. Learned counsel for the petitioners would further submit that this is a civil dispute between the parties, which is turned to be a criminal one only in order to threaten the petitioners. 04. Learned Assistant Public Prosecutor would submit that accused Nos.3 and 4 are the attestors of the alleged fake will. He would further submit that investigation in this matter would reveal that, at the instance of accused no.1, accused Nos.3 and 4 attested the document without knowing anything to them. 05. Considering the submissions made and on perusal of the material on record, petitioner No.1 is maid of Ms.Kanakadurga who is absolute owner of the property and the said Kanakadurga is died in an accident. She remains issueless. There are clear allegations made against the petitioners that they have created an unregistered will. The de-facto complainant in the present case is relative of Kanakadurga. As rightly put by the learned Assistant Public Prosecutor that, after receiving the 5 summons in the civil suit they got understand the creation of a forged will in favor of accused No.1 in this matter. Investigation is at crucial stage and the petition deserves dismissal. 06. Accordingly the Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________ Dr. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 09.02.2026 KKV 6 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 662 of 2026 Dt.09.02.2026 KKV 241
