[2026:RJ-JP:3334] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1210/2026 Sagar S/o Balram, R/o House No. 13, Raj Vihar Colony, Near K.c.r. Restaurant, Mathura (U.P.) (Presently Sipahi Unit-4, Jat Regiment B Company C.L.O. 56 A.P.O.) ----Petitioner Versus State of Rajasthan, through PP ----Respondent For Petitioner(s) : Ms. Saroj Singh for Mr. Yogesh Singhal For Respondent(s) : Ms. Arti Sharma, Public Prosecutor HON'BLE MR. JUSTICE GANESH RAM MEENA Order 23/01/2026 1. This anticipatory bail application has been filed under Section 482 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.354/2024 registered at Police Station Kotwali Bharatpur, District Bharatpur for the offences under Sections 61(2) (a), 318(4) and 318(2) of BNS, 2023. 2. Learned counsel for the accused-petitioner submits that the present dispute is civil in nature qua the monetary transaction of Rs.5,50,000/-. It is submitted that criminal flavour has been given to the same. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. 4. The co-accused, namely, Sonu has already been extended the benefit of anticipatory bail by Co-ordinate Bench of this Court vide order dated 06.11.2025. On perusal of contents of the FIR, it [2026:RJ-JP:3334] (2 of 2) [CRLMB-1210/2026] is revealed that the case of the present accused-petitioner cannot be said to be distinguishable from the case of co-accused-Sonu who has already been extended the benefit of anticipatory bail. 5. Considered the arguments advanced by the counsel for the parties, considering that present dispute is civil in nature; that accused-petitioner has been falsely implicated in the matter and looking to the overall facts and circumstances of the case and material on record but without commenting on merits or demerits of the case, this court is inclined to allow the anticipatory bail application of the accused. 6. Accordingly, this anticipatory bail application under Section 482 B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioner named above in connection with FIR No.354/2024 registered at Police Station Kotwali Bharatpur, District Bharatpur shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties in the sum of Rs.50,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
