This intra-court appeal seeks to challenge an order dated 11.08.2026 passed by the learned Single Judge, whereby W.P.(C)11285/2026 instituted by the appellant, has been disposed of with an observation that the reliefs, which were sought by instituting the writ petition can be sought by availing appropriate remedy before the Central Administrative Tribunal in view of This is a digitally signed order. Union of India, 1997 3 SCC 261 as reiterated by a Division Bench of this Court in Parikshit Grewal & Ors. v. Union of India & Anr., 2024:DHC:7692-DB. 3. The submission of the learned counsel for the appellant is that, as a matter of fact, the issue raised before the learned Single Judge in writ petition was in respect of the medical examination of the appellant for assessing as to whether, she was eligible to be considered in the category of a person with benchmark disability under the “blindness and low vision” category and therefore, the appellant has wrongly been relegated to the remedy under the Administrative Tribunals Act, 1985 by filing a petition before the Central Administrative Tribunal. 4. In our considered opinion, the aforesaid submission made by the learned counsel for the appellant, merits rejection for the reason that the appellant having appeared in the Civil Services Examination, 2025 and having secured All India Rank 342 was only being subjected to certain medical examination for assessing as to whether, she could be considered in the category of Persons with Benchmark Disability. The process, thus, is intrinsically involved with the process of recruitment and accordingly, the remedy available to the appellant lies before the Central Administrative Tribunal which in such matters, as laid down by the Hon’ble Supreme Court in L. Chandra Kumar (Supra) is a court of first instance. 5. At this juncture, learned counsel for the appellant prays that at least the respondents may be directed to reveal the result of the assessment made by the Appellate Medical Board. The said prayer cannot be granted by this Court once we have concurred with the opinion expressed by the learned This is a digitally signed order. If any petition laying her claim is presented before the Central Administrative Tribunal by the appellant, all such prayers will be available to be made by her before the said Tribunal itself. 6. For the aforesaid reasons, we are not inclined to interfere with the impugned order dated 11.08.2026 passed by the learned Single Judge, which is under challenge herein. The appeal along with pending application, if any, stands dismissed. 7. We may only observe that in case, the appellant invokes her remedy before the Central Administrative Tribunal by instituting appropriate proceedings, the Central Administrative Tribunal is requested to expedite such proceedings and conclude the same as early as possible.
