Heard learned counsel appearing for the parties. 2. The petitioner herein is accused in S.C.NO.10020/2021 (Crime NO.166/2020) on the file of the IV Additional District Judge, Bangalore Rural District at Doddaballapura, assailing the Order dated 08.02.2022 in Crl.Mis.No.10030/2022, inter alia, seeking an order to enlarge the petitioner on bail in S.C.No.10020/2021 in Crime No.166/2020 for the offences punishable under Section 395, 324 and 201 of IPC registered by the Doddabelavangala Police Station. 3. It is contended by the learned counsel appearing for the petitioner that, on health ground the petitioner was not able to appear before the Court below and therefore, the IV Additional - 3 - HC-KAR NC: 2026:KHC:21461 CRL.P No. 15875 of 2025 District and Sessions Judge, Doddaballapura, has rejected the petition preferred by the petitioner herein. It is also submitted by the learned counsel for the petitioner that, if the petitioner is enlarged on bail, the petitioner shall abide by the conditions that may be imposed by this Court. 4. Per contra, Smt. Waheeda M.M., learned High Court Government Pleader appearing for the respondent - State, opposed the petition on the ground that, there are four cases pending consideration against the petitioner and therefore submitted that, in the event if the petitioner is enlarged on bail, same would affect the societal interest and accordingly sought for dismissal of the Petition. 5. In the light of the submissions made by the learned counsel appearing for the petitioner, it is not in dispute that the petitioner is an accused in Crime No.166/2020 for the offences punishable under Sections 395, 324 and 201 of IPC. It is also forthcoming from the observation made by the IV Additional District Judge in Crl.Mis.No.10030/2022, that there are three more cases pending against the petitioner herein for similar offences. Taking into consideration the fact that, the petitioner - 4 - HC-KAR NC: 2026:KHC:21461 CRL.P No. 15875 of 2025 herein has continued his area of operation even after the pendency of three cases referred to in paragraph 8 of the Order at Annexure-C dated 08.02.2022 in Crl.Mis.No.10030/2022, I am afraid that, at this stage, releasing the petitioner on bail would affect the investigation and also there is a possibility of destroying the witnesses in the case.
