By way of the present petition, the petitioner seek quashing of FIR No. 0295/2024, registered at Police Station Badarpur, Delhi, under Sections 498A/406/506/34 of the Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties. 4. The Petitioners and Respondent No.2 are present before this Court and have been identified by the Investigating Officer (IO) concerned. 5. Briefly stated, the marriage between petitioner No. 1 and respondent This is a digitally signed order. No. 2 was solemnized on 16.02.2020 according to Hindu rites and ceremonies. One daughter was born from the wedlock on 23.07.2023. Owing to matrimonial disputes, the parties started living separately from September 2023, following which respondent No. 2 lodged FIR No. 0295/2024. During the pendency of the proceedings, the parties amicably resolved all their disputes through mediation and executed a Settlement Deed dated 04.01.2025, agreeing to put an end to all pending litigations. 6. On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed. 7. In view of the fact that the parties have amicably resolved all their disputes, the marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been paid, and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties.
There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 8. Accordingly, FIR No. 0295/2024, registered at Police Station Badarpur, Delhi, for the offences punishable under Sections 498A/406/506/34 of IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
