Mr. Namit Srivastava, learned advocate appears on behalf of review applicant. He submits, his client seeks review of order dated 2nd July, 2024, rejecting his special appeal preferred against order dated 22nd March, 2024 passed in review of writ petition disposal order dated 5th February, 2024. 2. His ground for review is error apparent inasmuch as on behalf of his client there was concession to extent that the writ petition could be disposed of in terms of judgment passed in Arvind Singh and others vs. State of U.P. and others, bearing neutral citation 2024:AHC:35239. In the circumstances, his client's appeal was good against rejection of the review on order dated 22nd March, 2024. He seeks review and recall of said order dated 2nd July, 2024. 3. Dr. D.K. Tiwari, learned advocate, Additional Chief Standing Counsel appears for State and vehemently opposes. 4. Petitioner has successfully demonstrated that where there have been two orders rejecting two different review applications arising from same judgment, appeal preferred against one is pending and his has been rejected. In the circumstances, omission of the Bench to notice the same can be argued to be error apparent. 5. Order dated 2nd July, 2024 is recalled on review. The Special Appeal is restored to file and number and be connected with Special Appeal no. 730 of 2024 (Akanksha Prajapati and 12 others vs. State of U.P. and 34 others) for Versus Counsel for Applicant(s) : Namit Srivastava Counsel for Opposite Party(s) : Archana Singh, C.S.C.
