Ms. Pooja Sharma, learned counsel appears for Mr. Manoj Sharma, learned Additional Advocate General and accepts notices on behalf of respondents. 3. Petitioner has challenged order dated 03.12.2025, whereby ignoring the fact that retirement of the petitioner on attaining age of superannuation is due on 31.08.2026, he was [2026:RJ-JP:7097] (2 of 2) [CW-1200/2026] transferred from Office of District Education Office Secondary, Kaurauli to Government Higher Secondary School, Bharatun. 4. Learned counsel for the petitioner submits that although petitioner filed appeal against the transfer order, however, instead of deciding the appeal on merits, the petitioner was granted liberty to submit a representation. 5. Accordingly, the petitioner submitted representation, however, the same has also been dismissed vide order dated 31.12.2025 without considering the fact that retirement of the petitioner is due on 31.08.2026. 6. Heard and considered. 7. In view of the aforesaid facts where retirement of the petitioner is due within a period of seven months, no fruitful purpose is likely to be achieved by transferring the petitioner at some other place. Therefore, in the light of judgment of Dr. Pushpa Mehta vs. RCSAT & Ors. reported in RLW 2000 (1) (Raj.) 233, this Court deems it just and proper to dispose of the present writ petition by directing the respondents to allow the petitioner to continue in the Office of District Education Office Secondary, Kaurauli, till his retirement. 8. Pending application(s), if any, shall stand disposed of. (ANAND SHARMA),J DAKSH/184
