Heard learned counsel for the Petitioners and learned counsel for the State. 2. The Petitioners are seeking pre-arrest bail in connection with Mahila P.S. Case No.30 of 2026 pending on the file of learned Court in seisin for commission of offences punishable under Sections 85/ 115(2)/ 296/ 316(2)/ 351(2)/ 3(5) of BNS, read with Section 4 of the DP Act. 3. During the course of submission, learned counsel for the State submits that in the case at hand the provision under Section 35(3) of BNSS has been resorted to by the Investigating Agency in respect of Petitioner Nos.2 and 3 (Kshitindra Mitra and Rashmi Rekha Mitra respectively). 4. In view of the same, since there is no imminent threat of arrest, the ABLAPL accordingly stands disposed of in respect of said Petitioners. 5. So far as the ABLAPL in respect of Petitioner No.1 is concerned, learned Counsel for the Petitioners submits that the exaggerated allegations have been made. Hence, the he may be protected by pre-arrest bail. 6. Learned Counsel for the State opposes the prayer for pre-arrest bail. 7. Taking into account the rival submission, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner No.1 (Anshuman Mitra) shall be released on bail by the learned Court in seisin on such terms as deemed just and proper. 8.
