1. This Court has considered the affidavit of compliance filed by the alleged contemnors, the exception taken by the petitioner/applicant thereto and the reply of the alleged contemnors.
2. The bone of contention raised by the learned Senior Counsel Mr. Debajyoti Basu for the petitioner/applicant is that his client was entitled to Modified Assured Career Progress (MACP) but has been wrongly denied the same. He also claims interest for delayed payment of terminal dues.
3. This Court is of the view that since the respondents have considered and then declined the petitioner’s entitlement to MACP, there is substantial compliance of this Court’s order and that of the Tribunal. The
entitlement of MACP and interest on delayed payment of retirement benefits are left open to the petitioner/applicant to agitate in an independent proceeding before an appropriate forum in accordance with law.
4. In view of the above, nothing further remains to be adjudicated in CPAN 170 of 2025. Hence, CPAN 170 of 2025 shall stand disposed of.
5. Consequently, all connected pending applications shall also stand disposed of.
6. Rule, if any, shall stand discharged.
7. Personal presence of the alleged contemnors is dispensed with.
8. There shall be no order as to costs.
