Learned counsel for appellant submits that he has erroneously chal- lenged the ex-parte impugned judgment and decree dated 22.07.2022 whereas the appellant has preferred an application un- der Order 9 Rule 13 of the CPC for setting aside the order dated 22.07.2022 before the Family Court Bilaspur and the same was 2 dismissed by the said Court on 28.06.2025. At this juncture, he seeks permission from this Court to withdraw the present appeal with liberty to challenge the order 28.06.2025 in accordance with law. 2. Learned counsel for respondent has no objection. 3. Prayer is allowed. 4. Accordingly, the present appeal is dismissed as withdrawn with the aforesaid liberty. 5.
