1. M MM SRINIVASA RAO Counsel for the Respondent(S):
1. GP FOR CIVIL SUPPLIES The Court made the following:
3
ORDER:
Impugning the notifications issued by the 4th respondent vide Ref.No.C/774/2024 & Ref.No.771/2024, dated 24.12.2024, inviting applications for appointment of permanent dealers for Fair Price Shop bearing Nos.1107009 &1107003 located at GodalaveedVillage and Narsireddypalli Village, B.Mattam Mandal, Badvel Revenue Division of YSR Kadapa District, the present Writ Petition is filed.
2. Heard Sri M.M.M.Srinivasa Rao, learned counsel for the petitioners and Sri Appasani Vineeth, learned Assistant Government Pleader for Civil Supplies for the respondents.
3.
Learned counsel for the petitioners while reiterating the contents of the affidavit contended that the petitioners have been appointed as Fair Price Shop dealers for the subject shops on temporary basis and discharging their duties since then. While so, without cancelling the petitioners’authorization, the 4th respondent has issued the impugned notification dated 24.12.2024 inviting applications for appointment of permanent dealers. He further submitted that if such notification is allowed and any members areappointed in place of the petitioners, it not only affects the rights of the petitioners, but their livelihood would also be affected. Accordingly, prayed to pass appropriate orders.
4. On the other hand, Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies submitted that the petitioners cannot question the notifications as they are temporary dealers and the respondents
4
have authority to appoint permanent dealers. If at all the petitionershave an intention to participate in the notifications, they can as well participate but cannot question the notification before this Court, as such, prayed to dismiss the writ petition being meritless.
5. Perused the record and considered the submissions made by the
learned counsel for the parties.
6. It is not in dispute that the petitionerswere appointed as temporary fair price shop dealers for the subject shops. While so, the 4th respondent issued notifications dated 24.12.2024 inviting applications for appointing permanent dealers. The said notifications have been assailed on the sole ground that notificationshave been issued without cancelling the petitioners’ authorization and they are still continuing as temporary dealers. The petitioners being temporary dealers will not have any legal right to question the notifications for filling up the vacancies with a regular candidate. The authorities have made it clear in the appointment order of the petitioners that the appointment is made purely on temporary basis.Further, nothing prevents the petitioners from making an application pursuant to the said notifications for selection of permanent dealers.
7. In view of the same, the petitioners have not made out any case warranting interference of this Court in questioning the notifications impugned. However, if at all the petitioners have an intention to make an application for appointment of permanent dealers pursuant to notificationsissued by the 4th respondent videRef.No.C/774/2024 & Ref.No.771/2024, dated 24.12.2024,
5
they can as well participate in the notification for appointment as permanent dealers. Till finalization of the notifications, the petitioners shall continue as Fair Price Shop dealers.”
8. Accordingly, the writ petition is disposed of. There shall be no
order as to costs.
As a sequel, miscellaneous applications, pending if any, shall stand closed.
