For issuance of an appropriate writ(s)/order(s)/direction(s) or a writ in the nature of Certiorari for quashing the order dated 16.01.2026 (Annexure-9) passed in Misc. Revision Case No.80 of 2024-25 passed by the respondent no. 2, whereby and whereunder, 2026:JHHC:16325 2 without properly considering the facts, material and evidences available on record, the respondent no.2 has erroneously rejected the revision filed by the petitioner preferred against the order passed by the Learned L.R.D.C., Seraikella in Misc. Case No.01 of 2023-24, which is wholly arbitrary, unjust and unsustainable in the eye of law. ii. For issuance of an appropriate writ(s)/order(s)/direction(s) or a writ in the nature of Certiorari for quashing the order dated 05.12.2024 (Annexure-8) passed in Misc. Case No.01 of 2023-24 passed by the Learned L.R.D.C. Seraikella, whereby and whereunder, the Learned L.R.D.C., Seraikella has allowed the appeal preferred by the private respondents herein and directed for cancellation of mutation done in favour of the petitioner, which is wholly unjust and unsustainable in the eye of law.” 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. The petitioner is challenging the Appellate Order and the Revisional Order by which the mutation of the petitioner has been cancelled at the instance of private respondents. 4. Now the petitioner has to establish his right, title and interest over the property and possession. Thus, the better course of action for the petitioner is to approach the Civil Court for declaration of his right, title and interest and for confirmation of possession or for recovery of possession, as the case may be. 5. Thus, I direct the petitioner to approach the Civil Court. 6. It is made clear that after the Civil Suit is decided, the 2026:JHHC:16325 3 Revenue Authorities will consider the judgment and the decree passed in Civil Suit produced by the petitioner and if required, make necessary correction under the Register, based on the judgment. 7.
