JUSTICE R.K. PATTANAIK Order No. ORDER 19.05.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Tamando P.S. Case No.96 of 2026 corresponding to C.T. Case No.286 of 2026 pending in the file of learned J.M.F.C.-I, Bhubaneswar on the grounds stated. 3. Perused the FIR as at Annexure-1. A case under Section 140(3) BNSS with other allied offences is registered alleging kidnapping of the victim by unknown miscreants. Learned counsel for the petitioner submits that the petitioner is not involved in any such kidnapping reported by the informant’s mother. Mr. Lenka, learned ASC for the State informs the Court that the victim’s statement under Section 183 BNSS has been recorded on 29th April, 2026, wherein, nothing adverse has been alleged against the petitioner. Considering the version of the victim as above, this Court, in absence of any such incriminating material found against the petitioner in connection with the alleged incident, is inclined to direct him to surrender before the learned court below for being released, though not in favour entertaining his bail plea pending investigation. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C.-I, Bhubaneswar in connection with C.T. Case No.286 of 2026 corresponding to Tamando P.S. Case No.96 of 2026 within three weeks from today, he shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
