The present application has been filed by the applicant for quashing the following:- "a. Charge Sheet No.13/2020 filed on 18.03.2020 in Case Crime No.337/2008 under Section 406, 409, 109,467, 468, 471 and 120B of IPC and Section 13(1)(d)(ii) of the Prevention of Corruption Act, 1988, Police Station Cantt, District Gorakhpur. b. Summoning Order passed by the court of Special Judge (Anti Corruption I), District Gorakhpur on 09.04.2021 against the Applicant under Section 406, 409, 109,467, 468, 471 and 120B of IPC and Section 13(1)(d)(ii) of the Prevention of Corruption Act, 1988; c. Entire proceedings of Sessions Trial No.746/2021 [State v. Ramchand & Ors.] court of Special Judge (Anti Corruption I), District Gorakhpur." 2. It is submitted by learned counsel for the applicant that in respect of the occurrence taken place from the year 2001-03 a first information report was lodged on 19.2.2008 and the charge sheet has been submitted on 18.3.2020 and the summoning order is issued on 9.4.2021. He submits that the present matter is covered by the judgment of this Court passed in Application under Section 482 No.39496 of 2023, Arjun Ram Vs. State of U.P. and another. 3. Learned A.G.A. for the State does not dispute the fact that the present Versus Counsel for Applicant(s) : Vinayak Mithal Counsel for Opposite Party(s) : Ajay Kumar Misra, G.A. Indradev Dwivedi .....Applicant(s) State Of U.P. And Naother .....Opposite Party(s) matter is covered by the judgment of this Court passed in Application under Section 482 No.39496 of 2023, Arjun Ram Vs. State of U.P. and another. 4. In view of the statement made by learned A.G.A. for the State and the judgment of this Court passed in Application under Section 482 No.39496 of 2023, Arjun Ram Vs. State of U.P. and another, the proceedings against the applicant in the aforesaid case is hereby quashed. 5. The present application is allowed.
