Heard Mr. R. Amin, learned counsel, appearing on behalf of the accused- applicant. Also heard Mr. M.P. Goswami, learned Addl. P.P., representing the State respondent. This is an application filed under Section 483 of the BNSS, 2023, praying for
Page No.# 2/3 granting bail to the accused-applicant in connection with Howly Police Station Case No. 147/2026, registered under Sections 319(2)/308(2)/318(4) of BNS, 2023, read with Section 66(c) of IT Act. An FIR was lodged before the Officer-in-Charge of Howly Police Station on 29.08.2026 by one Jahangir Alom, alleging, inter alia that on 09.08.2026 and 29.08.2026, some unknown miscreants had fraudulently withdrawn an amount of Rs. 2,37,000/- (Two Lakh Thirty Seven Thousand) from HDFC Bank account number 50200043974082, and Rs. 11,69,000/- (Eleven Lakhs Sixty Nine Thousand) from HDFC Bank account number 50200086843190 belonging to the informant. On the basis of the FIR, police registered Howly Police Station Case No. 147/2026, under the aforesaid sections. During the inquiry, the police found material against the accused-applicant and he was arrested on 29.08.2026 and since then he is in judicial custody. The learned counsel for the accused-applicant submits that the accused- applicant has been arrested merely on the basis of suspicion as he works in the restaurant belonging to the informant. He submits that since the accused-applicant has been inside the jail for a long time, his further custodial detention is not required for the purpose of investigation. On the other hand, Mr. D.P. Goswami, learned Additional Public Prosecutor, submits that there are sufficient materials against the accused-applicant, and the investigation is still ongoing in this case, and at this stage, the bail application should not be granted. Page No.# 3/3 Considering the submissions made by learned counsel for the petitioner, as well as materials available on record, this Court is not inclined to grant bail to the accused-applicant at this stage as the same will hamper the investigation.
In terms of the above observations, this bail application is dismissed as rejected. JUDGE Comparing Assistant
