Accused no. 1 to 5 are before this Court in this Criminal petition filed under Section 528 of BNSS 2023 with a - 3 - HC-KAR NC: 2026:KHC:12312 CRL.P No. 3329 of 2026 prayer to quash the entire proceedings in Crime No.60/2026 registered by Suddaguntepalya Police Station for the offences punishable under Sections 79, 115(2), 126(2), 351(2), 352 r/w Section 3(5) of BNS, 2023. 2. Learned counsels for the parties jointly submit that, dispute between the parties has been amicably settled at the intervention of elders and well-wishers of both the parties. The said settlement is voluntary without there being any undue influence or coercion. The alleged offences against the petitioners are all bailable and compoundable in nature. They submit that, parties have filed a joint memo supported by the joint affidavit of the parties and in view of the settlement arrived between the parties, the prayer made in the criminal petition may be allowed. 3. The said submission and the joint memo which is supported by the joint affidavit of the parties are taken on record. The parties who are present in person before the Court are identified by their learned advocates . In paragraph nos.2 to 4 of the joint affidavit which is filed in support of the joint memo by the parties, it is stated as follows: - 4 - HC-KAR NC: 2026:KHC:12312 CRL.P No. 3329 of 2026 "2. It is submitted that the dispute between the Petitioners and the Respondent No. 2, which led to the filing of the complaint, arose out of a trivial neighbourhood complaint, misunderstanding. With the intervention of elders, well-wishers, and family members, the parties have amicably resolved all their differences and have decided to put an end to the dispute. 3. The Respondent No. 2, being the original complainant, has no objection whatsoever to the quashing of the FIR in Crime No. 60/2026 and all proceedings emanating therefrom against the Petitioners. 4. It is submitted that the settlement has been arrived at voluntarily, without any force, fraud, coercion, or undue influence from any quarter. The parties have decided to restore peace and harmony in their neighbourhood." 4. The joint memo is signed by the parties as well as by their learned advocates. It is brought to the notice of this Court by the learned advocate that, FIR has been registered against the petitioners in present case for bailable and compoundable offences. Under the circumstances, I am of the opinion that, in view of the settlement arrived between the parties and also having regard to the averments found in the joint affidavit, which is filed in support of the prayer made in - 5 - HC-KAR NC: 2026:KHC:12312 CRL.P No. 3329 of 2026 the joint memo, the impugned criminal proceedings needs to be quashed. 5. Accordingly, criminal petition is allowed. 6. The entire proceedings Crime No.60/2026 registered by Suddaguntepalya Police Station for the offences punishable under Sections 79, 115(2), 126(2), 351(2), 352 r/w Section 3(5) of BNS, 2023. is quashed.
