THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 86/2026
JUDGMENT:
The present Criminal Revision Case has been filed by the State, challenging the Order passed by the learned Special Judge for SPE & ACB Cases-cum-III Additional District Judge, Vijayawada in Crl.M.P.No.73 of 2026 in Cr.No.5/RCO-CIU-ACB/2024 dated 22.01.2026.
2. Heard Sri S.Syam Sunder Rao, learned Special Public Prosecutor representing the petitioner and the
learned counsel for the respondent/accused through Video Conference.
3. Learned Special Public Prosecutor would submit that the present revision has been filed challenging the order dated 22.01.2026 passed by the learned Special Judge, granting permission to the respondent/accused No.4 to travel abroad from 30.01.2026 to 09.02.2026 by relaxing the bail condition of weekly appearance before the I.O. He would further submit that the learned Special Judge erred in considering the petition filed by the respondent/accused No.4, even though he had not submitted any documents in support of his alleged business dealings abroad along with his petition for the relevant period. Learned Special Public Prosecutor would further submit that there is every likelihood of the respondent/accused overstaying abroad beyond the permitted period.
4.
Learned counsel for the respondent/accused No.4 would submit that the respondent/accused No.4 is a businessman. He would further submit that
4
the respondent/accused No.4 has enclosed the travel itinerary and flight tickets along with the petition. The learned Special Judge, after taking into
consideration all the material placed before the Court, passed the impugned
order granting permission to the respondent/accused No.4 to travel abroad. He would further submit that there is no illegality or error in the impugned
order warranting interference by this Court in revision.
5. Considering the submissions made and upon perusal of the material placed on record, including the impugned order, as rightly pointed out by the
learned counsel for the respondent/accused No.4, there are no grounds to entertain the present revision. In that view of the matter, it is apposite to dispose of the present revision confirming the impugned Order dated 22.01.2026 passed by the Special Judge. However, the respondent/accused No.4 is directed to furnish the details of the tour schedule, including the place of stay and a mobile number which shall remain active during the period of travel to the Investigating Officer.
6. Accordingly, this Criminal Revision Case is disposed of.
Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 29.01.2026. UPS
