This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.385 of 2024, under Section 137(2), 87 and 64(1) of B.N.S. and Section 5/6 of POCSO Act, registered at Police Station Kunda, District Udham Singh Nagar. 3. An F.I.R. was lodged by the mother of the victim alleging that her daughter, aged about 17 years, went missing from her house on 07.12.2024 at about 02:00 p.m. The victim was subsequently recovered on 13.12.2024 from the company of the applicant. Upon medical examination, no internal or external injuries were found on her person. Immediately after her recovery, her statement was recorded under Section 180 B.N.S., wherein she categorically stated that she had left her home of her own free will and had solemnized marriage with the applicant. In her examination-in-chief, she has further stated that she remained in the company of the applicant for a limited period prior to his arrest. Learned counsel for the applicant submits that the relationship between the parties was consensual in nature and that the applicant undertakes not to misuse the liberty of bail and is ready to furnish adequate sureties to the satisfaction of the Court. 4. Per contra, learned State Counsel has opposed the prayer for bail. 5. Having considered the rival 2026:UHC:2539 submissions and perused the material available on record, this Court finds that the victim was below 18 years of age, though only by few days, and in her statement has supported the case of a consensual relationship and stated that she had voluntarily accompanied the applicant. It is further noted that no injuries, either internal or external, were found in the medical examination, and the applicant is in custody with the trial likely to take time. 6. Without expressing any opinion on the merits of the case, and considering the totality of facts and circumstances, this Court is of the view that the applicant is entitled to be released on bail at this stage. 7. The bail application is allowed. 8. Let the applicant, namely, Sanjay Kohli be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
