Also heard Mr B Sarma, learned Additional Public Prosecutor for the State of Assam and Mr R Bora, learned counsel for the informant, assisting the Additional Public Prosecutor. 2. By this application, the petitioners have prayed for pre-arrest bail in connection with Kheroni PS Case No. 36/2026, registered under Section 103(1) of the BNS, 2023
3. The First Information Report in connection with which the petitioners are apprehending arrest, was lodged on 31.08.2026, by the brother of the victim, stating, inter alia, that the victim, who got married to accused No. 1, arrayed as such in the FIR, was tortured physically and mentally by all the accused persons, including the petitioners regarding food. It was also stated that at 08:00 am, on 31.08.2026, the husband of the victim called up the informant and informed him that the victim had gone missing. The informant further stated that he suspects that the husband of the victim along with family members had assaulted and killed his sister and thrown her body somewhere. 4. The learned counsel for the petitioners submits that the petitioners are brothers-in-law of the victim and that they stay separately and as such, they have no role in the offence. 5. On the other hand, Mr B Sarma, the learned Additional Public Prosecutor for the State, on perusal of the Case Diary, submits that the body was found from the river in a decomposed state.
He further submits that there are statements of the witnesses stating that the petitioners had tortured the victim and had killed her and had thrown her in the river. 6. Upon consideration of the submissions made by the learned counsels appearing for the parties, more so, in view of the fact that the relatives of the victim had stated that the accused persons including the petitioners had tortured the victim physically and mentally, this Court does not deem it fit to enlarge the petitioner on pre-arrest bail, at this stage.
