1. The present Application under Section 151 of the CPC has been filed by the Petitioner seeking condonation of delay of 111 days in re-filing the present Petition. 2. Arbitration and Conciliation Act, 1996 by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes arisen between the parties under the Employment Agreement dated 18.09.2025 (hereinafter referred to as “the Agreement”). 5. Material on record indicates that under the Agreement, the Petitioner was appointed as Senior Area Manager with the Respondent Company on
18.09.2025. It is stated that vide Termination Letter dated 06.01.2026, the Respondent terminated the services of the Petitioner on the ground of non- performance during the Performance Improvement Plan. 6. It is the case of the Petitioner that the termination is arbitrary, stigmatic and contrary inasmuch as no show cause notice was issued to the Petitioner prior to the termination and no fair or transparent evaluation process was undertaken. 7. It is stated that Clause 19(f) of the Agreement contains an arbitration clause. The said clause indicates that the seat of arbitration shall be New Delhi. A notice dated 19.01.2026 under Section 21 of the Arbitration and Conciliation Act, 1996 was sent by the Petitioner to the Respondent invoking Arbitration. Since no reply has been received from the Respondent, the Petitioner has approached this Court by filing the present Petition seeking appointment of an Arbitrator. 8.
In view of the fact that disputes have arisen between the parties and the Agreement contains an arbitration clause, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 9. Accordingly, Mr. Chritarth Palli, Advocate (Mob. 9888277971) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties. This is a digitally signed order. 10. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 11. The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the 1996 Act within two weeks of entering on reference. 12. All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law. 13. Needless to say, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties. 14.
