IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT APPEAL NO: 103 of 2026 Bench Sr.No:-4 [3552]
Nelapudi Damodar and Others ...Appellant(s) Vs. The State Of Andhra Pradesh and Others ...Respondent(s)
********** Advocate for Appellant: Mr. G Simhadri Advocate(s) for Respondent(s): Mr. Gandrala Rathna Kumar, Standing Counsel for APSCCFC Ltd. GP for Services II
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 10th February 2026 P C : The present writ appeal has been preferred against the order, dated 07.01.2026, passed in W.P. No.34199 of 2025.
2. The petitioners had challenged the action of the Regional Transport Authority respondent No.5 in ordering “locking” of the vehicles in question on account of the default in repayment of loan, which is stated to have been obtained from the Andhra Pradesh Scheduled Castes Co-Operative Finance Corporation Ltd (APSCCFC). The order of “locking” appears to have been done at the behest of the aforementioned Corporation with a view to prevent

the petitioners – appellants herein from creating third party interest in the said vehicles and preventing any attempt to sell the vehicles in question. The learned single Judge, by virtue of judgment and order impugned, had issued directions not to seize the subject vehicles from the possession of the petitioners by virtue of the order, dated 10.12.2025. This order was subsequently vacated by virtue of order impugned, dated 07.01.2026, and hence the present writ appeal.
3.
Learned counsel for the appellants would submit that the action of
“locking” by RTA would prevent the petitioners from plying the passenger vehicles in question and therefore, would cause prejudice to the interest of the appellants.
4.
Learned counsel for the respondents, however, state that the mere action of the Authority in ordering “locking” only prevents a further sale and, therefore, in no way would the petitioners be prevented from either applying for the fitness certificate, if an application was filed in due course upon payment of the requisite fee, nor would the action of locking in any manner prevent the user of the vehicles in question.
5.
Learned counsel for the appellants feels satisfied with the aforementioned statement having been made, which we record accordingly. However, we make it clear that nothing would take away the right of the APSCCFC from resorting to such actions, which are otherwise permissible

with a view to recover the loan, which would also include seizure of the vehicles, if so advised. The writ appeal is, accordingly, disposed of. No costs.
Pending miscellaneous applications, if any, shall stand closed.
