It is the case of the petitioner that the petitioner was appointed as Personal Clerk in the second respondent society and retired from service. While so, the second respondent issued a notice dated 06.10.2021 calling upon the petitioner for an enquiry u/s 81 of society Act. The petitioner submitted her detailed explanation. The Enquiry Officer after conducting the enquiry, held that the charges were not proved against the petitioner. However, the second respondent ordered a re-enquiry. Subsequently, the petitioner was permitted to retire on 31.03.2024 by withholding her terminal benefits. Thereafter, no final orders were passed for the re-enquiry and therefore, the petitioner’s terminal benefits were not disbursed. Since there is no response for the petitioner’s representation, aggrieved petitioner is before this Court. 3. Heard the learned counsel on either side and perused the materials on record. 4. It is stated that though the re-enquiry had been completed and the https://www.mhc.tn.gov.in/judis WP No. 10648 of 2026 __________ Page3 of 4 Enquiry Officer has submitted his report to the second respondent as early as in the year 2022, the second respondent is yet to pass orders. Therefore, the Writ petition is disposed of with the following directions ie., mandamus is issued directing the second respondent to pass orders based on the report submitted by the Enquiry Officer on or before 28.04.2026. No costs. 5.
