24/02/2026 D/L – 35 Court No.28 S. Kundu Rejected C.R.M.(A) 459 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Nowda P.S case no. 182 of 2025 dated 1/7/2025 under sections 329(4)/118(2)/109/103(1)/61(2)/3(5) of the BNS and 3/4 of the Explosive Substances Act and 25/27 Arms Act. In the matter of: Mehebub Mondal @ Chatha @ Mehebub Sk & Ors. ...Petitioners. Mr. Sayan Mukherjee Mr. Anisur Rahaman …for the petitioners. Mr. Iqbal Kabir Ms. D. Ghosh …for the State. 1. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. The FIR was started against the 20 accused. Some other co-accused were granted bail by the Sessions Court. 2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the statements of eye-witnesses, the injury report and the post-mortem report. He submits that while one person was murdered three others were injured. The statements of witnesses implicate the petitioners. 3. Considering the above and the other incriminating materials available in the case diary, I do not consider 2 this to be a fit case to grant anticipatory bail to the petitioners. 4. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
