Ajay Mohan Goel, Judge (Oral) The petitioner has approached this Court, feeling aggrieved by Annexure P-3, order dated 27.06.2026, in terms whereof, he has been transferred temporarily from Jal Shakti Section, Nalti to Jal Shakti Sub-Division, Barsar.

Learned Counsel for the petitioner has vehemently argued that the transfer order is arbitrary, discriminatory, illegal, in violation of the transfer policy framed by the State Government and not sustainable in the eyes of law, being unconstitutional inter alia, on the ground that the petitioner earlier also was transferred to Nalti on temporary basis and now, again, he has been transferred to Barsar on temporary basis.
3. In light of the fact that the transfer was being vehemently opposed by the petitioner, this Court was curious to 1 Whether reporters of the local papers may be allowed to see the judgment?
2 2026:HHC:29095 know as to what was the distance between Hamirpur and Nalti and Nalti and Barsar. This Court has been informed that the places, in fact, are not distantly far away from each other. Nalti happens to be 15 km away from Hamirpur and Barsar also happens to be 15 km away from Nalti.

On a further query put to the learned Counsel for the petitioner since when the petitioner was serving in Sub Division Hamirpur, the Court was informed that the petitioner, in fact, is posted in Sub-Division, Hamirpur since the year 2006. In this backdrop, when the case was taken up in the morning session, it was impressed upon the learned Additional Advocate General that the grievance of the petitioner appears to be genuine and he cannot be treated as a football and transferred from one place to another on temporary basis.
5. Taking the observation of the Court seriously, now learned Additional Advocate General informs the Court that the petitioner has been permanently transferred to Barsar. As this takes care of the grievance of the petitioner that he should not be transferred from place to place temporarily, this petition is disposed of with the direction that the petitioner will be allowed to serve at Barsar for a normal tenure. As prayed for by learned counsel for the petitioner, if TA and DA is payable to the petitioner on account of this transfer, the same be paid to forthwith.
6. It is clarified that this permanent posting of the
3 2026:HHC:29095 petitioner at Barsar shall not come in the way of the petitioner in approaching the Authority to have himself adjusted at some other station. Pending miscellaneous application(s), if any, also stand
disposed of accordingly.
