1. This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short „the Act‟) for appointment of an arbitrator.
2. The brief facts are that the petitioner was appointed by the respondent as „Head of Tool Room‟ vide Appointment Letter dated 07.05.2018. Dispute arose between the parties regarding withholding of the Annual Variable Pay of Rs.7,26,000/- of the petitioner and the claim of Rs.10,00,000/- of the respondent. Clause 19 provides for resolution of disputes through arbitration. The petitioner invoked arbitration under Section 21 of the Act vide notice dated 02.04.2026. On failure to do the needful, the present petition is filed.

“In the event of any dispute(s), difference(s) or claim(s), counter claim(s), question arising out of or touching upon in connection with or in relation to this Agreement shall be referred to the Sole Arbitrator, as decided by the Managing Director of Company to adjudicate upon and whose decision shall be final, conclusive and binding. The Arbitration proceedings shall be governed in accordance with the provisions of The Arbitration and Conciliation Act, 1996. The place of Arbitration proceedings shall be at New Delhi.”

Learned counsel for the respondents on instructions has no objection for referring the matter to arbitration.
6. Accordingly, the petition is allowed by appointing Justice (Retd.) Mr. Rajan Gupta, (Mobile No.: 9780008140) as the sole arbitrator for adjudication of the disputes which have arisen between the parties.
7. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC). Fee of the Arbitrator shall be fixed as per fee schedule.
8. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.
9. It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties and it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law.
10. A copy of this order be forwarded to the learned Arbitrator for information.
