JUSTICE S SUNIL DUTT YADAV ORAL ORDER Petitioners have filed the present petition seeking to issue a direction to the respondents to consider the representation dated 30.05.2025 at Annexure-F. - 3 - HC-KAR NC: 2026:KHC:9703 WP No. 22401 of 2025 2. In terms of the representation at Annexure-F, the petitioners had objected to the acquisition process whereby 4 guntas of land of the petitioner was sought to be acquired. Petitioner had stated that if the road were to be made pursuant to the acquisition in the middle of the petitioner's property, the petitioners would be seriously prejudiced. Accordingly, petitioners requested that the road be shifted to the western edge of the petitioners’ property in Sy. No. 1023/2 and if such change in alignment is made, petitioners would have no objection for the acquisition process, as the petitioners’ agricultural interests would be taken note of. 3. Learned Additional Government Advocate has filed certain proceedings of the Assistant Commissioner before this Court. However, from such proceedings, it is noticed that the request of the petitioners is rejected. 4. Learned counsel for the petitioners submits that such consideration does not take note of the petitioners’ - 4 - HC-KAR NC: 2026:KHC:9703 WP No. 22401 of 2025 grievance that the road would dissect the property of the petitioners in the middle while petitioners had no objections if the road were to be on the western edge. 5. In light of the stand of the Government, petitioners submit that they would take appropriate steps to challenge the acquisition proceedings as per law and their stand of no objection for acquisition would no longer hold as the said stand was only in the event the alignment of the road was shifted from the middle to the western edge of the property. 6. In light of the same, the petition is disposed of as not calling for adjudication while reserving liberty to the petitioners to challenge the acquisition as per law if so advised.
