Order No.02 Dated- 08.06.2026
Heard the parties. The petitioner has moved this Court for grant of bail in connection with Barkagaon P.S. Case No.09 of 2026 registered for the offences punishable under sections 111(2)(b)/111(3)/317(5) of the B.N.S., 2023 and under Section 25(1-A)/25(6)/25(7)/25(1- B)(a)/26/35 of the Arms Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was in illegal occupation of a 9mm pistol having two live cartridges loaded in its magazine and one 9mm loaded carbine with three live cartridges loaded in its magazine and he is member of organized gang of criminal headed by Rahul Dubey and the arms and ammunitions were provided to him by Ashish Sao and the co-accused person Munika Kumari was in illegal possession of a weapon like AK47 and SLR in her almirah and they were planning to conduct a shoot- out in the colliery area on the on the order of Rahul Dubey and Ashish Sao. It is further submitted that the allegations against the petitioner are all false. It is then submitted that except in one case in which the petitioner is already on bail, there is no other case in which the petitioner is involved, as mentioned in para-14 of the bail application. It is next submitted that the petitioner has been in custody since 19.01.2026, as has been mentioned in rejection order
dated 11.03.2026 of the regular bail of the petitioner by the court below in Bail Petition No. 149 of 2026. It is then submitted that charge sheet has been submitted in this case but no witnesses has been examined so far. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail.
Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Hazaribagh, in connection with Barkagaon P.S. Case No.09 of 2026 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
