Heard Sri Abhishek Pandey, learned counsel for the petitioners, Sri Akshay Prakash Srivastava, learned counsel for the local body concerned as well as learned Standing Counsel for the State. By means of this petition filed under Article 226 of the Constitution, petitioners are aggrieved by the notice dated 10.09.2026, whereby, petitioners have been directed to produce the relevant material documents in respect of their title and possession of land, failing which, coercive action shall be taken against them. It is contended on behalf of the petitioners that the petitioners had even previously been served with identical notices to which they have adequately replied furnishing the documents upon which a detailed report was submitted by the Tehsildar on 12.09.2025. However, instead of taking any final action in the matter, yet again similar kind of notice has come to be issued. In the given facts and circumstances, we are disposing of this petition with a direction to the petitioners to furnish all the details and material documents that they have in their possession in response to the notice dated 10.09.2026 and annex therewith also the report dated 12.09.2025 and if they do so within a period of two weeks from today, the Executive Officer, Nagar Panchayat, Kurara, Hamirpur shall be taking a final decision in the matter of notice dated 10.09.2026 within a further period of two months, of course after giving full opportunity of hearing to the petitioners at the same time.
