01. I.O. alongwith the Case Diary is present.
02. He fairly conceded that the investigation is complete so much so the injured has been examined, who has since been discharged and the charge-sheet is ready to be filed before the competent Court of law.

Learned counsel for the petitioner states that the petitioner is in custody for the last more than 81 days though he is accused of offence under Section 109 BNS which is heinous in nature, but having regard to the fact that investigation in the case is complete, no useful purpose would be served in continuing the petitioner to remain in custody.
04. A case for enlargement of the petitioner is made out. The application is allowed. He is directed to be released from custody, subject to furnishing of surety and personal bond for an amount Rs. 1,00,000/- before the Registrar Judicial of this Court with the condition that he shall cooperate with the investigation and once the charge-sheet is Sr. No. 42

filed, he is directed to remain present before the concerned Court at the time of trial as and when called and, in case, the petitioner remains absent, the Investigating Agency is free to initiate action in accordance with law.
05. CD file is returned back to the I.O in the Court.
06. Application stands disposed of.
